• 1. General Open or Close

    The Postcode Lotteries Green Challenge is initiated by Nationale Postcode Loterij N.V., People’s Postcode Lottery, Svenska Postkodlotteriet and Deutschen Postcode Lottery (together: "the Postcode Lotteries") to encourage the development of new, innovative, creative and yet commercially viable products and/or services that contribute to an eco-friendly lifestyle, directly reduce greenhouse gas emissions and score highly on convenience, quality and design. The preliminary juries will assess the entries. After all the entries have been reviewed, the organisation will announce the 25 best start-ups by end-June and the five finalists early September. On 3 October 2019, the finalists will present their ideas to an international jury of experts and an audience of invited guests in The Netherlands. The winner(s) will be announced on the same date.

  • 2. Participation Open or Close

    1. The Postcode Lotteries Green Challenge is open to companies, businesses, institutions and all other organisations from any country.

    2. The Postcode Lotteries Green Challenge is not open to:

    • employees of the Dutch Postcode Lottery, People’s Postcode Lottery, Svenska Postkodlotteriet and Deutschen Postcode Lottery;
    • people under 18 years of age;
    • anyone who has been involved in or will this year be involved in judging the Postcode Lotteries Green Challenge;
    • immediate family members and/or household members of the individuals mentioned under (a) and (b) of this article; and
    • Parties in which DOEN Foundation directly participates are excluded from entering the Postcode Lotteries Green Challenge

    3. Parties who currently receive subsidies from DOEN Foundation can enter the Postcode Lotteries Green Challenge, but if they win any prize money DOEN Foundation and the Dutch Postcode Lottery have the right, at their discretion, to reduce the subsidies.

    4. To enter the Postcode Lotteries Green Challenge, each participant must submit − via the entry form on the website www.greenchallenge.info, which form is hosted by The Golden Egg Check − a business plan for a product or service as described under article 6.1 and all other documents and information as specified on the entry form ("Entry") in time.

    5. The closing date and time for receipt of Entries is 1 May 2019, 12:00pm CEST (noon, Amsterdam time). New Entries or amendments in Entries received after the closing date shall not be considered. Also, incomplete Entries that were completed after the closing date shall not be considered.

    6. All Entries must be in English. Entries in any other language shall not be considered.

    7. Incomplete, illegible and/or unintelligible Entries shall not be considered.

    8. The Postcode Lotteries reserves the right to exclude anyone and any Entry from the Postcode Lotteries Green Challenge at any time, for any reason and without prior notice.

    9. Submitted Entries, including any material related there to, such as sample products, designs and drawings, shall become the sole property of the Postcode Lotteries and shall not be returned. As regards intellectual property rights concerned, reference is made to article 3.

  • 3. (Intellectual Property) Rights and Indemnity Open or Close

    1. Participants grant the Postcode Lotteries the irrevocable, perpetual, worldwide right to publish and use in connection with the Postcode Lotteries Green Challenge, (parts of) the (subject/content of the) Entries in any and all media, including but not limited to the Internet and publicity material, without limitation and without compensation to the participants.

    2. Each participant shall have the sole responsibility for securing any potential intellectual property rights related to his/her Entry, such as by applying for a patent or a design. The Postcode Lotteries shall not be liable for any costs incurred or loss, damage, injury, expense or liability suffered by participants in relation to any failure to successfully secure any intellectual property rights related to the Entries as a result of participation in the Postcode Lotteries Green Challenge.

    3. Each participant warrants that:

    • all information provided with his/her Entry is true, complete and accurate;
    • his/her Entry is his/her own original creation and that he/she is the sole author and proprietor of the Entry;
    • his/her Entry does not infringe any third party (intellectual property) right;
    • he/she has not sold, assigned or otherwise transferred and/or granted any rights in the Entry to any third party prior to entering the Postcode Lotteries Green Challenge;

    4. Each participant shall indemnify and hold the Postcode Lotteries harmless against any loss, cost, damage, injury or expense that the Postcode Lotteries may incur as a result of any breach by the participant of article 3.1.

    5. Submitting an entry does not constitute a transfer of ownership of any intellectual property rights from Participant to the Postcode Lotteries Green Challenge.

  • 4. Data Protection Rights and Publicity Open or Close

    1. The Postcode Lotteries shall not sell, rent, loan, trade or lease the personal data to any third party. As far as it concerns the processing of personal data of the participants, the Dutch Postcode Lottery is data controller in the sense of the General Data Protection Regulation and DOEN Foundation, which will pay the Prize Money as described in article 7.1, is data processor. The Golden Egg Check is also data processor. The Dutch Postcode Lottery processes personal data for the purpose of providing the Postcode Lotteries Green Challenge and hereby makes use of data processors.

    2. Participants grant the Postcode Lotteries the irrevocable, perpetual, worldwide right to publish and use in connection with the Postcode Lotteries Green Challenge, their personal data, such as their name, country of origin, videos, photographs in any and all media, including but not limited to the Internet and publicity material, without limitation and without compensation to the participants.

    3. Participants agree to fully cooperate with and participate in all publicity and promotional activities and/or press conferences regarding their participation in the Postcode Lotteries Green Challenge and/or their Entries.

    4. Participants agree not to engage in any conduct that is detrimental to the name and/or reputation of the Postcode Lotteries, the Postcode Lotteries Green Challenge and/or other participants, including but not limited to bringing such name or reputation into any disrepute or ridicule.

    5. Participants agree not to make any public announcements or take part in any media coverage regarding their participation in the Postcode Lotteries Green Challenge and/or their Entries without the prior written consent of the Dutch Postcode Lottery.

    6. The Postcode Lotteries share the names of subscriding companies with third parties.

  • 5. No Liability Open or Close

    1. The Postcode Lotteries shall not be liable for any late, lost, delayed, misdirected, damaged, incomplete or illegible Entries.

    2. The Postcode Lotteries shall not be liable for any damage resulting from the participation in the Postcode Lotteries Green Challenge, including but not limited to death, personal injury or other loss or damage resulting from for example experiments or other preparation or fulfilment of their Entries.

  • 6. Judging Procedure Open or Close

    1. All Entries shall be evaluated based on the following criteria:

    • potential to reduce greenhouse-gas emissions, specified as a roughly estimated yearly reduction amount;
    • executability;
    • realisability as a usable product or service within the next two years;
    • integration of the Cradle2Cradle principles
    • communication potential, courageousness and creativity
    • any other criteria the Preliminary Jury and/or the Jury, both to be appointed by the Postcode Lotteries, in their sole discretion deem relevant.

    2. Participants may be required to provide further information to assist the Preliminary Jury and/or the Jury in assessing their Entries. Each participant agrees to fully cooperate with the Preliminary Juries and/or the Jury to provide such information.

    3. Judging is a three-stage procedure.The judging of the Postcode Lotteries Green Challenge is a three-stage procedure. In the first stage, after the entry period has closed, the preliminary juries from the UK, Sweden and Germany will review the entries from their region. The Dutch preliminary jury will assess the entries from The Netherlands and from outside the aforementioned regions. After all the entries have been reviewed, the organization at its sole discretion shall select 25 nominees by end-June 2019, from these nominees the organization will select five finalists ("Finalists"). Finalists shall be notified by phone by early September 2019 and shall be required to come to Amsterdam from 30 September 2019 up to and including 3 October 2019 to present their Entries before an audience. Finalists who fail to present their Entries in Amsterdam forfeit their place and the organization shall be entitled to offer the forfeited place to any other participant. Finalists should be available for travel from 30 September up to and including 3 October 2019.

    4. The Postcode Lotteries shall reimburse reasonable travel and lodging expenses incurred by one person per Finalist, only if approved in advance, in writing, by the Dutch Postcode Lottery.

    5. Submitting an Entry is free of cost, but each participant bears any costs of researching, preparing and completing his/her Entry.

    6. At the third stage, the Jury at its sole discretion shall select one or more Winners. The Winner(s) will be announced at an award celebration.

    7. All decisions made by the organization and/or Jury are final and binding.

  • 7. The Prize Money Open or Close

    1. The Prize Money will be awarded by the Jury to the Winner and consists of a total amount of €1,000,000. Instead of awarding the Prize Money completely to one Winner, the Jury is also allowed to divide the total amount of the Prize Money between several winners in any possible way. The Prize Money will be paid by DOEN Foundation.

    2. The Postcode Lotteries may cancel, withhold and/or postpone awarding the Prize Money, if, in the opinion of the Jury, the standard of the Entries so warrants. The Prize Money cannot be transferred or substituted, except by the Postcode Lotteries, which shall be entitled to substitute the Prize Money at any time for any reason, without prior notice and without any liability whatsoever.

    3. The Prize Money will be used solely for the implementation and/or exploitation of the winning Entry or Entries and the marketing thereof.

    4. The Winner(s) agree to implement and/or exploit the winning Entry themselves. To be entitled to assistance from leading entrepreneurs and/or companies with respect to such implementation and/or exploitation, the Winner(s) must enter into an agreement with the DOEN foundation stipulating the terms and conditions regarding such assistance.

    5. The Prize Money shall not be transferred to any bank account in the name of an individual. If the Prize Money is awarded to (an) individual(s), he/she/they, in a form to be agreed with by the DOEN foundation in advance and in writing, will be required to establish a legal entity and open a bank account in the name of said entity, to which bank account the Prize Money will be transferred. The DOEN foundation is furthermore entitled to impose upon the Winner(s) other obligations which will need to be fully met before the DOEN foundation will transfer the Prize Money in whole or in part.

    6. The Postcode Lotteries may at its sole discretion refuse to award the Prize Money to any Winner who fails to comply wholly or in part with any of these Terms and Conditions.

    7. If it comes to the attention of the Postcode Lotteries that a Winner has in any way failed to comply with (part of) these Terms and Conditions, the Postcode Lotteries reserves the right, for a period of one year from the initial pay date, to recover from the Winner part or all of the paid out Prize Money, as it deems fit.

  • 8. Duration Open or Close

    1. The Postcode Lotteries Green Challenge ends on the date on which the Winner(s) is/are announced or any other date if the Postcode Lotteries Green Challenge is cancelled or abandoned as stipulated in article 8.2.

    2. The Postcode Lotteries shall be entitled to cancel and/or abandon the Postcode Lotteries Green Challenge at any time, for any reason, without prior notice and without any liability whatsoever.

  • 9. Miscellaneous Open or Close

    1. Each participant shall have the sole responsibility for any taxes, duties, charges or levies to be paid to any third party in connection with any money (including the Prize Money) he/she pays or receives in connection with the Postcode Lotteries Green Challenge. Each participant shall indemnify and hold the Postcode Lotteries harmless against any loss, cost, damage, injury or expense which the Postcode Lotteries may incur as a result of any breach of such responsibility. The Postcode Lotteries shall not be liable for any costs incurred or loss, damage, injury, expense or liability suffered by participants in relation to such taxes, duties, charges or levies to be paid.

    2. The Postcode Lotteries shall be entitled to modify each of the Terms and Conditions and/or to impose new rules and regulations in respect of the Postcode Lotteries Green Challenge at any time for any reason, without prior notice and without any liability whatsoever. The modified and/or newly imposed Terms and Conditions will be effective immediately upon being posted on the website www.greenchallenge.info.

    3. Nothing contained in the Terms and Conditions shall be construed as creating any employment, agency, partnership, or joint venture relationship between the Postcode Lotteries on the one hand and the Winner(s), Finalists or any other participant on the other hand.

    4. The invalidity of any of the Terms and Conditions shall not affect the enforceability and/or validity of any other Term(s) and Condition(s).

  • 10. Governing Law & Jurisdiction Open or Close

    1. The Postcode Lotteries Green Challenge and the Terms and Conditions shall be governed by the laws of the Netherlands.

    2. Any and all disputes that may follow from or are related to the Postcode Lotteries Green Challenge and/or the Terms and Conditions shall be referred to the competent court in Amsterdam, the Netherlands.
